NCAA Loses O'Bannon Case

The result of this is that the big universities with all their powerful alumni will have an amendment made to the relevant antitrust laws to exempt them. Crush both this and the unionization. The thing that won't happen, and it's too damned bad, is that the NCAA won't be given the ability to take back control of the TV deals.

For clarification, this ruling means the NCAA cannot prohibit student-athletes from profiting from use of their names, images and likenesses, especially when the NCAA is the one using their names, images and likenesses. However, this does not mean players get to be paid just for playing.

So players can profit from jerseys, video games, etc., but what does this mean for the Reggie Bush/Cam Newton-style, under-the-table payments? Does the NCAA have the authority anymore to tell players, "No, you can't take that money"?

In all likelihood, it means the players can only receive money related to legitimate purchases of their name and likenesses. The total amount or money they can receive is capped at a certain rate (I think $5,000). It will be like receiving a job from a booster.

If players receive additional payouts, those would still be under the table and not allowed.

I could easily see this playing out as a booster paying an athlete for "an autographed picture" the day he commits to the school or after a big game. But given that memorabilia is such a big business, that would probably be a fair market transaction.

To be clear, the judge's decision was that $5,000 is the MINIMUM that can be received. Now the NCAA will probably also declare that the maximum, but does this fall under the jurisdiction of the NCAA, or will the 5 "power conferences" get their own say on this matter?

Regardless, it's the beginning of the end for the NCAA. Eventually, the power conferences will totally separate themselves so they can keep ALL the money, and the NCAA will cease to exist shortly thereafter.

Yeah, this doesn't mean (yet) that you can start handing out cash to players, but it kinda sorta does. You can bet that wherever the NCAA sets the number, a lot of players are going to hit it the first day on campus when some booster buys a thousand jerseys with the kid's name on them.

I am disappoint. I thought Mak's first post in this thread would be the RonPaulitshappening.gif. :(

Does this mean that FBS will splinter into two factions - the P5 conferences and the rest, which will become a division in between FBS and FCS?

Schools and boosters have been remarkably creative in skirting the rules and finding loopholes in order to get players paid - this ruling seems like it will simply loosen restrictions and open newer ways to get players what they've deserved all along.

I have a feeling this is the beginning of the end of my interest in college football. When and if the conferences split I think I'm done. If the only differences between college football and the NFL are the names and logos on the uniforms and the fact that players only have four years of eligibility I won't waste my time. When players start getting paid and the big rich schools tell the smaller poorer ones to piss off, college football will just be a shittier version of the NFL.

Just to be clear, I'm not debating the merits of the issue.

Worst, is this not already the case?

The conference-jumping that several schools have done just in the past decade or so already has significantly eroded any sense of "tradition" that the sport so proudly professes. I'm all for individual schools and their administrations/athletic departments trying to find the best deal for themselves, but the inevitable byproduct is a mishmash of manufactured conference affiliations that ignores decades of prior relationships/rivalries.

And yet, I'll still be tuning in every week to watch USC and whatever other game(s) that look interesting to me. :dunno:

Yeah the Power 5 being granted their own rulebook happened independent of (and prior to) this ruling.

This is the basic justification for enforcing amateurism in college athletics.

I get that but I'm not arguing it from a philosophical standpoint. I'm not arguing anything actually. I'm just wondering what the impact will be if college football becomes nothing more than an inferior professional league.

Good. Now all of those Little Leagers who are on espn for the World Series can start getting a small paycheck; not to mention all of those high school football and basketball teams who get tv time.

Part of me feels like w2f

But I think it's just an emotional reaction

I think what will drive me away from cfb is on field advertising during the game like they r doing with nfl games.

Atrocious.

What will keep me into all forms of football is that it is free entertainment (or sunk cost entertainment) on weekends. It is good background noise as I work on my dynasty as well.

all of this keeps me out of casinos every weekend. The value of keeping me out of casinos every weekend outweighs any perceived shortcomings of the game.

I really don't see the problem. College football has been a business for decades. People liked to pretend these players are amateurs. So a kid can sell his name and likeness, make some coin from the university. What changes the game that isnt already there?

I'm only speaking for myself. I've been losing interest in college football for the last few years. More meh, less outrage.

I'm drifting more towards the nfl as well which I attributed largely to the ridiculousness of no playoff in college maybe tgat will change now.

as the season wears on in college it becomes less compelling but as it wears on in the nfl it becomes more compelling. I attribute this to the nature of "ok if these two undefeated teams don't lose they get the Bcs title game berth so those are the only games that matter" nature of the thing.

its got nothing to do with the level of financial benefits the kids get. However I do believe they should receive compensation commensurate with thur skills and abilities.

I'm there, too. It's not because of the commercialization, it's more because of the ESPN-ization of everything. I'll watch Michigan's games, probably the playoffs, and that's about it. I'll throw college football on Saturday if I have nothing else to do, but the days of me not doing anything but watching college football on Saturday are over.

I think that's mostly because now my free time is much more limited than when I was in school. In school, for the most part, I had tons of time to do whatever I wanted. Now, I really don't get that much time to do whatever. Saturday is one of those days, and I'd honestly rather spend it doing things other than sitting on a couch staring at a screen for 12 hours.

I also think that a lot of it has to do with how shitty the games are. Early in the season, there aren't any good games on at all. Late in the season, so few teams are left in a meaningful race that there so few good games. I mean, just look at this list of top 30 OOC games: http://athlonsports.com/college-football/top-30-non-conference-games-watch-2014

The only one that got my jimmies rustled was MSU-Oregon. The rest is a big pile of meh. I suppose LSU - Wisconsin could be good. So, until October, there won't be any big games, and by November, there will be 3 or 4 games in the entire month that actually mean something.

I still love watching CFB, but the ongoing change makes me happy for the athletes.

College football imo has more to offer than the illusion of amatuer athletics .

The style of play on offense and defense is much more diverse than the nfl where everyone especially on offense essential runs the exact same thing.

Even though schools are changing confrences players really arebt so rivalries if only in your on conference are more exciting.

U dont think college will ever be a shitty version of the nfl

I assume theveryone ncaa is appealing. Question to me is, if the appeals court affirms and the ncaa appeals to scotus, will they grant certiorari on a seemingly settled issue just because of the profile of this case?
